Legislative initiative is a tool that allows the public to be a part of the new laws or try amend existing laws.
When justifying the necessity of passing a certain law, the proponent of the law (Working groups inside the Parliament and the Government) can also refer to petitions and proposals that, in accordance with the Constitution of the Republic of Croatia, citizens of the Republic of Croatia have the right to submit to state and other public bodies, and in their content indicate the need to pass or amend a particular law.
Public authorities are obliged to publish on the website the draft law and other regulations on which a public consultation is carried out with the interested public, through a portal called e-Consultataion (e-Savjetovanje). The portal e-Consultation offers a quick and simple search for open consultations, and effective advocacy of all interested social groups and individuals in the process of shaping public policies.
A legal way which citizens can act is through a citizens’ initiative. Given that these are informal forms of organizing citizens, citizens' initiatives are not regulated by a special law, nor is a register kept about them. In their activities they are obliged to comply with the Constitution and laws of the Republic of Croatia.
Citizen initiatives can involve individuals, but also organizations (associations) and it is primarily about gathering to solve a specific problem in the community. In accordance with the Law on Associations, civil initiatives are informal civil organizations that can act publicly as such, but cannot participate in legal transactions, which means that they do not have their OIB or public account and cannot receive funds from the public sector.
What are the requirements with which your initiative must comply?
Any citizen eligible to vote for the parliament has a right to take part in a legislative initiative. To take part on the e-Consultation portal you have to login into your e-citizen (e-građani) account.
